Trump sued over Truth Social's market-moving data sales

A federal lawsuit challenges Trump Media's sale of advance access to the president's posts, a service generating up to $100,000 a month per client that raises significant legal and market-integrity questions.

President Donald Trump faces a civil lawsuit in Manhattan over a subscription service that sells advance notice of his Truth Social posts, a product explicitly marketed to those trading on "market-moving" government announcements.

The service, Truth API, was unveiled in July by Trump Media. Chief Executive Kevin McGurn disclosed on an earnings call Monday that the company has signed more than 10 customer agreements, with fees ranging from $60,000 to $100,000 per month.

The Intercept Media and the Freedom of the Press Association filed the suit, arguing the arrangement violates the First and Fifth Amendments. They claim the president is effectively charging "unreasonable sums" for preferential access to public government information.

For investors, the lawsuit highlights both a newly confirmed revenue stream for Trump Media and a severe regulatory risk. The complaint focuses heavily on the financial mechanics of the arrangement. "The President stands to gain financially by giving 'market-moving' government information to those who are willing and able to pay his personal company," the suit states.

McGurn pushed back against the premise of preferential access during Monday's call. He framed the product as a standard data tool, stating it provides machine-readable feeds of publicly available posts in milliseconds. "Our customers will get published and publicly available posts fractionally faster," McGurn said.

The company plans to expand Truth API into financial data terminals, news feeds, and specialty publications. This positions Trump Media to directly compete with established financial data providers. It leverages the unique, algorithmic value of the president's communications as a standalone business vertical.

Alongside Trump, the lawsuit names his executive assistant Natalie Harp, White House Deputy Chief of Staff Dan Scavino, and the executive office of the president. The case could determine whether monetizing millisecond advantages on presidential communications constitutes a legal data product or an unconstitutional pay-to-play scheme.
